It is important for design professionals to understand and consider the impact of proposed construction upon adjacent properties and the obligations project owners have to adjacent property owners.  All parties should understand building code requirements to protect and prevent damage to adjacent properties, as well as the consequences of ignoring these requirements, including delays in the development process.  It is of great benefit to property owners, design professionals and builders/developers to enter into access agreements with adjacent property owners that provide for access to comply with building code requirements and, in addition, to avoid issues that often impact projects.
